Venn Network, LLC (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Venn Network mobile application, website, and related services (collectively, the “Service”) to do the same.
This DMCA Copyright Policy supplements and is consistent with Section 11 (DMCA / Copyright Policy) of our Terms of Use.
Company operates an online social media platform and is committed to complying with the notice-and takedown procedures set forth in the Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Reporting Copyright Infringement
If you believe that any content available through the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our designated agent with a written notice that includes the information required by 17 U.S.C. § 512(c)(3). Our designated agent's contact information is:
Designated DMCA Agent
Venn Network, LLC
PO Box 13570
Ogden, Utah 84412
Email: dmca@findmyvenn.com
To be effective under the DMCA, your written notice should include at least the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works on the Service are covered by a single notification, a representative list of such works).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Service (such as a URL or specific in-app location).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a valid DMCA notice, we will take appropriate action, which may include removing or disabling access to the allegedly infringing material and, in appropriate circumstances, terminating the accounts of repeat infringers.
Please be aware that if you knowingly misrepresent that material or activity on the Service is infringing, you may be liable for damages (including costs and attorneys' fees) under 17 U.S.C. § 512(f).
2. Counter-Notification
If your content has been removed or disabled as a result of a DMCA notice and you believe this was done in error or that your use of the material is authorized, you may submit a counter-notice in accordance with 17 U.S.C. § 512(g) to our designated DMCA agent at the address above.
A counter-notice should include:
- Your physical or electronic signature.
- Identification of the content that has been removed or to which access has been disabled, and the location at which the content appeared before it was removed or access to it was disabled (such as a URL or specific in-app location).
- A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled.
- Your name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside of the United States, for the United States District Court for the District of Utah), and that you will accept service of process from the person who provided the original DMCA notice or that person's agent.
We may restore the removed content in our discretion as permitted by law and as described in our Terms of Use, unless we first receive notice that the original complaining party has filed an action seeking a court order to restrain you from engaging in infringing activity.
3. Repeat Infringer Policy
Consistent with our Terms of Use, in appropriate circumstances and in our sole discretion, we may terminate the accounts of users who are determined to be repeat infringers. We also reserve the right to remove or disable access to content and to take other action we deem appropriate where we believe a user is infringing or has repeatedly infringed the intellectual property rights of others.
4. Non-Legal Advice
This DMCA Copyright Policy is provided for informational purposes only and does not constitute legal advice. If you have questions about your rights or obligations under the DMCA or other applicable laws, you should consult your own legal counsel.
